§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all services offered by englisch-lehrer.com (EL), James I. Simmonds, Schaufelder Straße 11, Hannover, as well as to orders placed by course participants and other contractual partners with EL.
§ 2 Subject of the Contract
The services offered by EL include in particular English language courses in the form of individual or group lessons, as well as other services such as proofreading and editing, translations, and business consulting (on a fee basis).
§ 3 Conclusion of the Contract
The contractual relationship between the contractual partner/course participant and EL is established upon binding registration by the contractual partner and acceptance by EL. Registration can be made in writing (letter, fax, email, or via the internet) or orally (in person or by telephone).
§ 4 Services and Fees
The services offered by EL and the associated fees are determined and agreed upon in a cost estimate, either in writing or orally. Unless otherwise agreed, one lesson unit is 45 minutes.
Travel allowance: If the course location is more than 5 km from the EL address, a travel allowance of 25 EUR (once per course date) applies. This will be invoiced with the course fee. For mini-groups (2-3 participants) and group courses (4-6 participants), this travel allowance is divided among the number of participants.
§ 5 Payment Terms
Unless otherwise agreed between the parties, fees are generally due in monthly installments or upon placing the order and are payable within 14 days. In case of late payment, EL is entitled to charge reminder fees and, after an unsuccessful second reminder, to demand default interest.
§ 6 Withdrawal and Termination by the Contractual Partner/Participant
Cancellation of individual lesson appointments without cancellation fees is possible up to 24 hours before the respective appointment. Cancellation must be made by telephone, SMS, or WhatsApp at 0171-6456267 or by email to [email protected]. Lessons cancelled later or not attended will be charged in full.
Termination of the contract (ending all booked lesson appointments) can only be made in writing (including email) to the following address or email address:
Termination of an individual lesson contract (with a duration of more than one month) can be made at any time with a notice period of 4 weeks.
§ 7 Withdrawal and Termination by EL
EL is entitled to terminate the contract if the contractual partner fails to meet their payment obligations or if the contractual partner disrupts lessons and/or endangers other participants. In case of termination by EL, the contractual partner will be refunded all prepaid services not yet used.
§ 8 Contracts for the Benefit of Third Parties
If a contractual partner books a course for the benefit of a third party (e.g., employer for employee, parents for their children), the payment obligation towards EL extends solely to the booking contractual partner, not to the third party. Participation of third parties is only permitted with written consent from EL.
§ 9 Withdrawal Fees / Cancellation Costs
For contracts where a total sum is agreed upon and invoiced in advance, the following cancellation fees will be charged in case of withdrawal by the contractual partner:
- 30 days before course start: 10% of the course fee
- 21 days before course start: 20% of the course fee
- 14 days before course start: 40% of the course fee
- 7 days before course start: 75% of the course fee
- On the day of course start or later: 100% of the course fee
EL is entitled to offset these cancellation costs against advance payments made by the contractual partner.
§ 10 Liability
Liability of EL and its employees for damages suffered by a contractual partner or course participant is excluded unless an employee of EL caused the damage through intentional or grossly negligent conduct. In particular, EL is not liable for the achievement of learning objectives by the course participant.
§ 11 Place of Performance and Jurisdiction
Place of performance and jurisdiction is Hannover. The law of the Federal Republic of Germany applies.
